Apostille Attestation

Apostille is a simplified process for certifying public documents (including attested ones) for international use in all countries that are party to the Apostille Section of the Hague Convention. Signatory nations have agreed to recognize public documents certified by the “Apostille.” This certification ensures that public documents are valid in the country where they were originally issued or legally authenticated.

It outlines the procedures through which a document issued in one of the signatory countries can be authenticated for legal purposes in other signatory states. This authentication is known as an Apostille. Apostille stickers are affixed by authorized authorities designated by the government of a country that is party to the convention.

The primary purpose of the Apostille is to verify the authenticity of the signature on the document (e.g., State Registrar, County Clerk, Judge, Vital Records Officer, or Notary Public). The Apostille also confirms the capacity in which the individual signing the document acted and the identity of any stamp or seal attached to the document. It is a one-page certificate adorned with the Great Seal of a State (see sample image) and includes the signature of the person issuing the certificate.

Currently, there are more than 75 member countries of the Hague Convention, and many more nations are expected to join the Apostille Section in the future, allowing them to recognize the Apostille for the international validation of documents. The Apostille applies only to public documents signed by an authority or official associated with a court or tribunal of the State. This includes documents issued by administrative, ecclesiastical, or ministerial courts or tribunals, as well as public prosecutors, clerks, or process servers. It also covers notarized acts and official declarations that relate to documents signed by individuals in their private capacity, such as certificates confirming the registration of a document or its existence on a specific date, along with official and notarial verifications of signatures.

An Apostille is a form of authentication that certifies documents in a specific format recognized by all countries that are part of the Hague Convention. Essentially, an Apostille serves as a global validation accepted in approximately 92 countries, with most of the Western world recognizing its legitimacy.

An Apostille stamp is a square-shaped, computer-generated sticker affixed to the back of a document by the Ministry of External Affairs, Government of India. This unique stamp features a distinctive identification number that allows any member country of the Hague Convention to verify its authenticity online. Typically, once a document has been apostilled, it does not require further verification from the relevant embassy.

Once a document has been apostilled, it does not require further notarization.

Following are the countries that have signed The Hague Convention and are member of it. As they are signatory members of the Apostille treaty they do not require a compulsory MEA general attestation and demand MEA to issue Apostille to the documents intended to be used in their country. But the requirement of attestation and Apostille can vary depending upon the type of document.
